1. Introduction and Applicability

These Terms and Conditions (hereinafter referred to as the “Terms”) govern the access to and use of the website https://www.premiumpadel.eu (hereinafter the “Website”), owned by “Падел Едно” ООД, EIK BG208687491, with registered office and management address at: гр. Варна, ж.к. Владислав Варненчик, бл. 3, вх. 3, ап. 19, Bulgaria (hereinafter the “Company”, “We” or “Seller”).

The Website is an online store for the sale of padel-related products (rackets, balls, apparel, accessories, etc.) intended for individuals within the European Union.

By visiting, browsing, or placing an order through the Website, you confirm that you have read, understood, and accept these Terms without reservation. If you do not agree with any of them, please do not use the Website.

The Company reserves the right to amend these Terms at any time. Amendments shall take effect from the date of their publication on the Website and shall apply to all orders placed after that date.

2. Definitions

  • User – any natural person who registers a profile or places an order through the Website.
  • Order – a purchase proposal made by the User via the Website.
  • Contract – a sales contract concluded between the Company and the User.
  • Products – all goods offered for sale on the Website.

3. Registration and User Profile

To place an order, you must create a user profile. Registration requires the provision of the following data: name, email address, and phone number. The User is obliged to provide accurate and up-to-date information. The Company shall not be liable for any issues arising from incorrect data.

4. Orders and Conclusion of Contract

Every order placed through the Website constitutes an offer to conclude a contract. The contract is deemed concluded at the moment the Company confirms acceptance of the order by sending a confirmation email.

5. Prices and Payment

All prices on the Website are in euros and include VAT where applicable. Payment is made exclusively via Shopify Payments using a credit or debit card. Cash on delivery is not available.

6. Delivery

Deliveries to European Union countries are carried out by the courier company DPD. Each shipment is provided with a tracking number, which is shared with the User. The data necessary for delivery (name, address, phone, email) is transferred to the courier.

7. Right of Withdrawal and Returns

The User has the right to withdraw from the contract within 14 calendar days from the date of receipt of the goods, without stating a reason. To exercise this right, the User must submit a completed withdrawal form, which is included with every shipment. Return shipping costs are borne by the User, unless otherwise agreed.

8. Warranty and Liability for Defects

The Company guarantees that the products sold correspond to their description and are free from hidden defects. In the event of a defect, the User is entitled to repair, replacement, or refund in accordance with applicable law.

9. Limitation of Liability

The Company shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of profit, loss of data, or business interruption, regardless of the cause. The Company’s liability is limited to the value of the specific order.

10. Intellectual Property

All intellectual property rights in the Website, logos, images, texts, and other materials belong to the Company or its licensors. Copying, reproduction, or distribution without prior written consent is prohibited.

11. User Conduct

The User undertakes not to use the Website for unlawful purposes, not to publish offensive content, and not to infringe the rights of third parties.

12. Dispute Resolution

In the event of a dispute, the parties shall first attempt to resolve it amicably. The User may also use the European Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr.

13. Applicable Law and Jurisdiction

These Terms are governed by Bulgarian law. All disputes arising in connection with these Terms shall be resolved by the competent Bulgarian courts, unless mandatory provisions of the law of the User’s country of habitual residence provide otherwise.

14. Changes to the Terms and Conditions

The Company reserves the right to amend these Terms. Users will be notified of material changes by publication on the Website and/or by email at least 14 days before they take effect.
